AuctionBytes Newsflash ran an article on September 19, 2007 about eBay seller Timothy Vernor, who is suing VeRO member Autodesk Inc.

And please don't get $ signs in your eyes and think this is a good idea.
This suit in my opinion is full of emoting and short on legal statute.
You can't ask for damages because the other side has money, you have to quote the legal statute that gives you the right to seek damages.
Additionally he broke one of the major rules, you don't keep relisting an item that has been taken down then act all surprised when you get suspended.
Also from what I can see from the papers he's filed he filed the suit the begining of August but hasn't served the other side yet.
There are rules and procedures to follow and apparently he is not.
A suit like this makes it tougher for other pro se ligitants. |

I ran into the same issue with AutoDesk and their zealous attorneys. I was selling a used AutoCAD manual on eBay that I bought from the local Goodwill store and it was taken down for VeRo issues.
After trying to get a hold of the VeRo complaint I finally tracked down the law office and called them. They said that I was in violation because I was selling something that was a package with the software and the license agreement that I signed when I bought the software would not allow me to split them apart and the book was bound with agreement of the software.
I asked them to show we on what page of the book that this was stated and to also prove I was a licensed holder. They could not prove either and I indicated that if they were such a hot shot law firm for AutoDesk that they should proof read the material to make sure their claims were valid. I told them I was going to call AutoDesk myself and explain what happened and how I was treated.
They indicated that they would look into it and within 2 weeks eBay automatically reinstated my item.
I never sell software because of the licenses agreements but I do sell manuals for the software that I pick up at thrift stores and yard sales. If the software is in the package I trash it just for the manuals.
I wish Tim good luck in his efforts.
