Or, if you know who the real rights holder is have them contact eBay and assert their rights and tell them to tell eBay not to allow these other people to do so.

I know someone who got shutdown and she contacted the rights holder who resolved it for her.

i am currently having the same problem. I'll refrain from giving the users ebay user name on here. I was wondering how people are getting on in there progress either suing ebay or taking this further or getting ebay or vero to listen? i am from london UK.

We need more information. Why are you refraining from using the eBayers name here?

Is it a competitor or a VeRO member?

You don't sue eBay, you go after the VeRO member but what were you selling? Have you tried contacting the VeRO member?

Right here goes. I have a website and im trying to sell some projectors we have on ebay. There are about 5 people selling the same item. My user name is www-hixley-com and the user who has got me removed is user rafsp1200. They claim they own copyright and trademark of the brand i am selling. They do not, atall. The manufacturer has said they do not. I tried contacting the vero member and all they say is take it up with you solicitors. They have no number and i found a phone number on there website www.unixdigital.co.uk and its only a mobile, which is definately suspicious. They have ruined me, this is a student enterprise and ebay was to be our largest selling ground, and now after 3 sales, we have been suspended for 7 days. Its a nightmare. We have taken our own pictures in a stuidio and changed our listings so they are not similar and still got removed. The user rafsp1200 is a fake vero member and simply a resseller as i am, just they are a power member so they have phone support, there seems to be nothing we can do as ebay sent messages back and i quote:

"eBay is not in a position to decide whether your item actually infringes copyright, trademark or other intellectual property rights because we're not experts in the rights of each specific rights owner. If you believe a mistake has been made, please contact the rights owners directly at rafsp1200@hotmail.co.uk if you haven't already done so."

So basically, there saying once someone sends a fax, they have a liscence to remove anyone. Its completely unfair competition.


I've requested a counter notice, but due to my suspension or maybe they have given up, they will not reply. If anyone has any ideas let me know. Im definately looking to join anyone who wants to sui ebay for the way they have simply allowed this to happen and ignored the possibility that this Vero member is fake!

If you have a store you can get supposrt. And don't believe that just because they have PS support they are getting any help.
