Hi guys,

I just wanted to post to find out if anyone else was hit last week by what I feel is an extremely Dodgy VERO owner. Im 99% sure this is a competitor seller who is misusing VERO. (ebay id is icbnsolution )

To give a little history i was selling on ebay a number of compilations offering various freely available mobile phone unlocker tools and guides (In fact some of these guides we actually authored our selves by representing the techniques and procedures we learned from others on various mobile/cell phone & technical forums). So the items in question are definitely either authored by us (We obviously don't own the knowledge only our document) or were a compilation of free to distribute items. (Again very easy to find, top page in google etc etc)

Despite being sure of myself I still gave the benefit of the doubt to the VERO owner! I mean maybe I had accidently infringed on some software developers rights or maybe one of these developers had a change of heart on their free distribution policy. So I contacted this so called owner but Low and behold no response!

Even after sending them over 50 emails all extremely polite and to the point. This guy is non existant, doesn't answer any questions on what the problem is and when prompted with questions of evidence and mentioning the documents we wrote I heard nothing.

As you can see its extremely shabby and a cut and paste effort from various documents I presume. Even the grammar doesn't sound right but at the bottom he has to say a cliched

"All data herein has been reviewed and edited by a copyright attorney."

Even his copyright years are inconsistent, one says 2004 the other 2000..

As usualy eBays not interested so at present i have filed Counter Notice Forms to see if this guy responds. And the irony of the matter is that I can't even take this guy to court because I don't know who he is, all I have is that silly about me page and his email address that he never responds too. In fact even a quick whois lookup is privacy protected. I feel so vulnerable with VERO owners like this on the prowl. I mean he can lay claim to anything and eBay don't give a damn!

My main question is has anyone else been hit by this guy ??? I would just be curious to know???

Did you receive confirmation from eBay that they were forwarding your counternotice?

Under the DMCA there is nothing that requires him to respond to your emails.

Hi Tabberone,

thanks for all your help so far and yes just as an update

1.) I have continued to try to contact this guy (No results)
2.) I have confirmation from eBay that my counter notice has been forwarded.

The VERO Owner has until the 13th April to respond or provide proof of legal action.

Will keep you all posted.

Here's another idea if they continue to be a problem.

File a suit against John Doe company. With a case number get a subponea for eBay and for the hosting company of their web address.

Ask for the contact information. The hosting company would probably contact the owner and see if they want to fight.

If they do and there is a court hearing then you find out who they are, if they don't fight you still find out who they are.

Is there a law school around you? Or some cheap legal aid that you can tap into to get some help on this?

Sorry for the delayed response, but what you suggest sounds like a good idea. I will have to consider it... I didnt know you could get at somebodies identity like that, aren't i glad you're on this forum....

A further update, ebay have sent me messages saying that my CounterNotice went through and that my items were removed in error and are available for relisting Thats good news i guess

However my account is still suspended and I dont want to go through the reinstatement process where I have to sign that form, especially since my suspension was because of the 20 or so items the VERO owner took down. I contacted ebay and they said that all re-instatements have to be done by faxing that form in... Where do i stand with this ??

Check your email, I've sent you the email addresses of some folks at eBay and also a request that you forward me all the emails you've received about this.

Under the DMCA once the rights holder doesn't respond to the CN and eBay has said the listings were removed in error they can't demand that you comply with their silly a$$ request.

I'm having similar troubles regarding ICB NetSolutions filing VeRO complaints to ebay and having my listings removed. Have you ever got your problem sorted and if so would you be so kind as to offer some advice on what to do!!

This is indeed a malicious eBay user who has been filing fraudulent VERO claims to remove competition and I have been gathering intel with various sellers

I see this saga continues. If anyone needs any further info or help with them Im happy to help although it does seem as though things have moved on a little.......

Btw hes not the only person misusing VERO there are 100s of other dirty sellers which are doing it and I have documented a lot of their ebay user ids...

I think i need to put my findings up on a website or something.. lol.. maybe even write a book.

Im glad someone is making the effort to take this guy down..
